Disco Camera 利用規約

1. 適用
本規約は、加納駿 / Shun Kano（以下「開発者」）が提供する iPhone アプリ「Disco Camera」（以下「本アプリ」）の利用条件を定めます。本アプリを利用することで、利用者は本規約に同意します。
App Store から取得した本アプリには、Apple Standard EULAが追加のライセンス条件として適用される場合があります。本ページは Apple との契約を置き換えません。
2. 本アプリの内容
本アプリは、iPhone のカメラとマイクを使って短い動画を撮影し、端末内でエフェクトを加え、録画後にレビュー、写真への保存、共有を行うカメラアプリです。
3. 端末、権限、利用環境
利用者は、対応する iPhone と iOS、および本アプリの動作に必要な空き容量を用意し、カメラとマイクへのアクセスを管理します。写真への保存を選ぶ場合は、写真への追加権限も管理します。権限を与えない場合、対応する機能は利用できません。
4. 撮影と第三者の権利
利用者は、撮影する場所、人物、音声、作品、標章その他の対象について、適用法令、施設の規則、プライバシー、肖像権、著作権その他の第三者の権利を確認し、必要な同意または許可を得る責任を負います。撮影禁止の場所や方法で本アプリを使用しないでください。
5. 動画の権利
撮影した動画の権利は、利用者または正当な権利者に帰属します。開発者は動画を取得または保管せず、本アプリの提供に伴って動画の権利譲渡を求めません。
6. 禁止事項
利用者は、次の目的または方法で本アプリを使用してはなりません。
- 法令、公序良俗、施設の規則に違反する行為
- 第三者のプライバシー、肖像権、著作権その他の権利を侵害する行為
- 嫌がらせ、脅迫、監視、盗撮、なりすまし、詐欺その他の有害な行為
- 本アプリの安全性または正常な動作を損なう行為
7. 外部サービスへの共有
利用者が iOS の共有シートで選んだ外部サービスには、その提供者の規約とプライバシーポリシーが適用されます。利用者は、共有先、受信者、公開範囲、送信内容を確認する責任を負います。開発者は外部サービスを管理しません。
8. 変更、中断、終了
開発者は、保守、技術上の理由、法令対応その他の必要がある場合、本アプリの機能を変更し、提供を中断または終了することがあります。開発者は、状況が許す範囲で重要な変更を案内します。
9. 保証と責任
本アプリは現状有姿で提供されます。開発者は、本アプリが中断せず動作すること、すべての端末や撮影状況に適合すること、録画または保存が成功することを保証しません。利用者は、重要な動画が写真に保存されたことを確認してください。
開発者は、適用法令が許す範囲で、本アプリの利用または利用不能から生じる間接損害、特別損害、付随的損害、逸失利益、データ消失について責任を負いません。ただし、消費者契約法その他の強行法規により制限または免除できない責任には、この制限を適用しません。
10. 未成年者
未成年者は、必要に応じて保護者または法定代理人の同意を得て本アプリを利用してください。
11. 規約の変更
開発者は、本アプリまたは法令の変更に応じて本規約を改定する場合があります。改定時は本ページの施行日を更新します。
12. 準拠法と管轄
本規約は日本法に準拠します。本アプリまたは本規約に関する紛争について、法令上許される範囲で、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Disco Camera Terms of Service

1. Application of these Terms
These Terms govern your use of Disco Camera for iPhone (the “App”), provided by 加納駿 / Shun Kano (the “Developer”). By using the App, you agree to these Terms.
The Apple Standard EULA may apply as an additional license term when you obtain the App from the App Store. This page does not replace your agreement with Apple.
2. App scope
The App uses the iPhone camera and microphone to capture short videos, applies visual effects on your device, and lets you review, save to Photos, or share a recording.
3. Device, permissions, and operating environment
You are responsible for a compatible iPhone and iOS version, available device storage, and your Camera and Microphone permissions. If you save to Photos, you also manage add-only Photos permission. A function may be unavailable if you deny its required permission.
4. Lawful recording and third-party rights
You are responsible for following applicable law and venue rules, and for respecting privacy, publicity, copyright, trademark, and other third-party rights in the people, audio, works, and places you record. Obtain any consent or permission you need. Do not record where or in a manner that recording is prohibited.
5. Ownership of footage
You or the applicable rights holder retain ownership of footage you create. The Developer does not receive or store your footage and does not require a transfer of rights to provide the App.
6. Prohibited use
You may not use the App to:
- violate applicable law, public policy, or venue rules;
- infringe privacy, publicity, copyright, or other rights;
- harass, threaten, stalk, secretly record, impersonate, defraud, or otherwise harm another person; or
- compromise the App’s security or normal operation.
7. Sharing through external services
A service you select in the iOS share sheet applies its own terms and privacy policy. You are responsible for checking the destination, recipients, audience, and content before sending. The Developer does not control external services.
8. Changes, suspension, and discontinuation
The Developer may change App functions or suspend or discontinue the App for maintenance, technical reasons, legal compliance, or another operational need. The Developer will provide notice of a material change when circumstances permit.
9. Warranty and limitation of liability
The App is provided “as is.” The Developer does not warrant uninterrupted operation, compatibility with every device or recording condition, or successful recording or saving. Confirm that an important video appears in Photos after saving.
To the extent permitted by law, the Developer is not liable for indirect, special, incidental, or consequential loss, lost profits, or lost data arising from use of or inability to use the App. This limit does not exclude or restrict liability that mandatory consumer law does not permit the Developer to exclude or restrict.
10. Minors
Minors should obtain consent from a parent or legal guardian where required before using the App.
11. Changes to these Terms
The Developer may update these Terms when the App or applicable law changes. The effective date on this page will identify an update.
12. Governing law and venue
Japanese law governs these Terms. To the extent permitted by law, the Tokyo District Court has exclusive jurisdiction as the court of first instance for disputes relating to the App or these Terms.
